Legal Question in Workers Comp in California
Help! I need to file a workers comp lien for providing Living Expenses to an Injured Worker (he is past due on rent for one year). Can I file the lien myself or do I need an attorney? How do I obtain the info needed to complete the lien? Do I need to appear bf the workers comp board for the lien?
1 Answer from Attorneys
(1) Can I file a Lien myself? yes.
(2) How do I obtain the info needed to complete the lien? Pay an attorney to write you up a game plan. www.dir.ca.gov has SOME free info, but nobody is going to give you all the legal advice you need for free.
(3) Do I need to Appeal before the Workers Comp Board for the Lien? Yes... when Lien Claimants don't appear, the WC Judge has the authority to issue a dismissal of the lien for failure to appear and prosecute.
