Legal Question in Workers Comp in California
Hi I filed a petition for reconsideration regarding workers compensation but was denied. I was directed to now file a petition for a writ of review. I am having a hard time finding another attorney to represent my case. I have contacted the bar association for a referal. That has been unsuccessful and frustrating. Have any suggestions!

Check with the local applicants attorney organization and then the State group to see if you can find an attorney that way. You do not give any information as to what the issue was, but since the WC judges and Board is very liberal, if both of them rejected you there seems to be little chance of your winning. The rules have changed, but decades ago I believe you had to go to the Court of Appeals and not superior court to challenge the Board ruling. Most attorneys will not handle the case because the typical charge for an appeal is $15,000-20,000, so at a 13% attorney's fee you need a case worth around $200,000, plus part of the fees go to your prior attorney. Attorney's do not like to stick their necks out on a weak case with inadequate value, that will cost they a lot to handle. And few have handled any appellate work.
