Final Settlement Question
I am having problems finding info regarding the final settlement process for a WC case. I do have my QME rating and they have not answered my ''demand'' so I guess there are two basic types of settlement, lump sum or a certain amount per week. I need to know what the difference tax and otherwise are between the two. If there is a book or particular website that you could recommend it would be welcomed. I might also need a attorney before all this is over because it looks like I am getting in over my head. Thanks a lot.

You may have to bring it before the worker's compensation appeals board judge. An application for adjudication and a DOR is required. The worker's compensation system is very adversial. The insurance companies will get away with anything they can. They will pay you the minimum on your claim unless you obtain representation to protect your interests. The worker's compensation insurance companies have attorneys, why don't you? Attorney fees are limited by law to 9% to 12% of the final settlement or award. Call me directly at (619) 222-3504.
