Legal Question in Workers Comp in California

If I find out the company that I work for has no workers comp ins or has let their insurance go. Can I leave the company and file for unemployment benifits until I find a better company to work for?

The EDD will generally refuse benefits for any worker who quits then demands Unemployment Benefits.

If you're hurt and there's no insurance, the State's Uninsured Employers Fund -- dubbed "UEF" in the Comp 'World' -- will cover your work injury.

So you might be wiser to stay employed AND LOOK FOR A NEW JOB with an insured employer(unless you are certain you will be hurt someday soon and you can afford to live on no Unemployment Insurance and no wages for the months/years it takes to get a new job).
