Legal Question in Workers Comp in California

follow-up on a previously answered question.

Attorney for an Injured Worker (I.W.) filed a Workers Compensation claim against me as an Uninsured Employer (U.E.). Filing date was in April, 2007 at a local WCAB. About 2 years later, my attorney (at that time) was served with a SNOL . She refused service and called the opposing counsel that a SNOL could only be served to the employer (me), the defendent. It is now 3 1/2 years after the original WCAB filing. Is there a statute of limitations regarding presenting a SNOL summons to an U.E.? Thanks for any considerations.
