Legal Question in Workers Comp in California

Need some good Help

I have been on WC since Sept 05,My employer held up the claim on me hoping it would go away.They did this for 42 days,I went into the hospital on my heath ins.

Come to find out I had 2 disks in my neck that were gone from running heay equipment for 15 yrs and being in the construction field for 27yrs. By the time I did get some help I was one step from a wheel chair.Had a 50 50 chance of walking out of the hospital. I have taken what my Doctor calls a Trumatic Spinal Cord Injury.

I have run out of Heath Ins. Due to the fact that my hours reflected my Ins. No hours no Ins...

What can I do,If I get hurt Ill lose everything........

On 10-10-06 my doctor put my back on light duty.From that time untill now I have been waiting for something to come up from the place I work now. On 2-5-07 State fund sent me a letter saying they were stopping my TD Because I missed 2 doctors Appts. But I did not have one I was on light duty waiting to try to go back. It also said I owed them 7400 dollars for over payment of TD from 11-24-06 to 1-19-07.

Can they do this?

What laws did my employer break?

What is the fine for willfully knowingly holding up a claim such as mine?

Can I put the one that did it in Jail or at least out of her job
