Legal Question in Workers Comp in California

Why is it hard to find a lawyer willing to go to the uninsured employers fund?

My ex employer was not insured when I was hurt. Now I am having a hard time getting a lawyer to go get my money from the Uninsured Employers Fund. Why is it hard to get a lawyer to do this? My ex employer is denying my claim and I have had 2 chriropractors release me from treatment. They want me to get spinal injections and I do not want too. My MRI says my back has some normal degeneration, but I still am hurting.

The odds

The odds are the attorney representing you will not get paid. Additionally, there is usually a trial concerning the employer's lack of insurance. The employer usually represents themselves. With the employer involved, the proceeding take a lot of court time, which cuts down on the already regulated recovery the applicant's attorney receives.

You can see a personal injury attorney and proceed in Civil Court if the employer was uninsured. The standards are higher, but so can be the recovery.
