Legal Question in Workers Comp in California
Hi,
I was injured in a work related injury about year ago. My jobs insurance comany, Sentry, has played games from then until now. From telling me I'm not eligible for gas compensation (because I'm not a full time worker) to tricking me to go to appointments so that their doctors will disagree with my doctors. My first deposition was scheduled to be in December, then they rescheduled the week before. The next one was in February and they rescheduled the day before. My next deposition is in April and I'm worried they will cancel again.
I've been on state disability since September. Well only temp disability because they still don't know the extent of my injuries. My doctors have just found out I have a torn ligament in my right wrist.
So, my question is: How do I keep them from stalling?
Also, right after my injury they sent me to physical therapy within 2 weeks of the injury. It made my wrist worse I believe. I couldn't use it much a few months and stressed my left wrist. They refuse to accommodate to my left wrists pain. It's not as bad as the right but I get throbbing and numbness in my fingers, forearm and wrist.
Is the insurance company obligated to treat it?
Last question, I promise. I was going through training for a promotion when I got hurt and as soon as I did it stopped. The training didn't hinder my work at all and I could have still been trained while injured. I know this because most or all of it was paper work and working on the register(I worked retail). I was even asked to wash windows and dust after I got hurt but for some reason I can;t be trained. I called my district manager about the issue and she said my manager wouldn't train me any further until I was better.
I read that they aren't supposed to do that and that it's disability discrimination. From what I've described is it?

I really recommend that you retain an attorney at this stage that you have a deposition coming up.
