Legal Question in Workers Comp in California

HIPAA & Workers' Compensation

The AME disclosed THE DETAILS of very personal gynocological information and previous/now treated and ''cured'' of Hepatitis C in his review of medical records for an orthopedic injury. I had bi-lateral carpal tunnel and right thumb trigger release. I have also made complaints of pain in my ''thumb pads,'' in my neck, trapezium and upper back due to inadequate office furnishings Is this a violation of HIPAA since I see no relation whatsoever between my orthopedic condition and my gyn and past Hepatitis conditions. This info has been released to the opposing attys., the insurance/risk management company and the liason from human resources at my job

Workers comp is exempt from HIPPA in general. You should note that the information contained in your comp claim is confidential, so you really should not worry.
