Legal Question in Workers Comp in California

I hurt my arm at work June of 2010, after physical therapy and steriod shot I returned tp work in October 2010.

January 2011 my arm began to hurt again so they sent me back to doctor. I was put on modified duty, waiting for appointments with specialist, during this time I was notified that my modified time was about to run out still waiting for this to get taken care of. My modified time ran out and now I have been off since April 4, 2011, I am being paid by the state but I really just want to have the surgery and return to work and it is taking so long is there anything I can do to speed it up

I cannot answer your question without additional information: Was your claim accepted by the insurance company? Why are you receiving money from the state? If your claim is accepted and your employer has no modified duty for you, then the insurance company should be paying you temporary disability benefits. Was your surgery authorized? If not, you need to speak to an attorney. You can find one in your area by going to the California Applicants' Attorneys Association Website at www.caaa.org.

On a more personal note, I tell my clients, quite seriously, that workers' compensation claims take longer than you think it should. Good luck.
