Legal Question in Workers Comp in California
My husband works part time for a company. Does he have the right to have workers compensation?

By State law, all employers must provide Workers' Compenstion insurance coverage for all employees, no matter how many hours per week they work. The only difference between part time and full time employees is that since the temporary disability rate is based upon earnings for that employer, the more hours you work the higher the rate will be. People who are truly independent contractors do not have coverage, but what the employer designates the position as does not control, rather it is the nature of the relationship to the employer.
