Independent contractor

A small business owner ecently hired me as an independent contractor. Who is required to carry workers' comp?

If you're an independent contractor, then the employer is not responsible for a work-related injury. The real question is however, are you really an independent contractor? The answer requires analysis. Sometimes the employer likes to make some workers an independent contractor only to relieve themselfs from the responsibility of workers' comp. insurance, but many times, it's just a scam that doesn't work.

I will not get into the analysis, but perhaps another lawyer would like to chime in on this one with the analysis.
