Legal Question in Workers Comp in California
I injured my back at my job in California. I went to their doctors and they are so mean and try to kick me out. I wouldn't let them, and they are giving me therapy now and acupuncture. I am still working all this time and need to leave work for treatment once per week.
Now my work is hassling me because recently another worker was careless and struck me causing another work related injury claim. I know they are hassling me because of this.
Can I be compensated for time off work for treatment? My back is starting to hurt real bad now ( 6-months ), can I take time off when it hurts? I have to stand all day at work.

You ae entitled to be fully compensated for any time actually lost from work because of going for medical treatments. If yo are at work, that would include when you leave from work to the time you get back. Get your treating Dr. to write a report that because you have to stand all day, whilch is not good for your back, there wil be time yo wil have to stop working because of the increase in back pain and at those times you should be taken off work.
YOU NEED TO CHANGE YOUR TREATING DOCTOR. ONLY AN INDEPENDANT DOCTOR WILL PROPERLY TAKE YOU OFF WORK. YOU MAY ALSO APPLY FOR EDD BENEFITS (STATE DISABILITY INSURANCE) AND THE INSURANCE COMPANY WILL HAVE TO REIMBURSE THEM AS WELL. FEEL FREE TO CALL US AT 213.388.7070 FOR A FREE CONSULTATION.
