Legal Question in Workers Comp in California
Injured back at work
Hi. 2 years ago I was carrying a heavy windshield through the hallway at work (I used to install windshields), slipped on a puddle of motor oil spilled on the floor, fell, & injured my back pretty bad. A doctor examined me & gave me a 20% disability. He recommended not to lift anything heavier than 5 pounds. I was in constant pain for almost a month after my fall. When the pain started to ease a bit, it still hurt for several months. I had to take painkillers, had a hard time moving about, laying down, standing, sitting. What hurt the most emotionally is that I couldn't even pick up my 3-month old daughter, couldn't have any ''relations'' with my wife, etc. Of course, after my fall I couldn't install windshields anymore, so I had to look for another job. According to my attorney, I could only count on some financial compensation after the re-evaluation of my condition. A whole year later, a doctor who re-examined me said that it was his professional opinion that I was doing much better, & soon would completely recover. Since the re-evaluation came back negative, I'm not eligible for any financial compensation for my injury! But don't I deserve something for suffering all this time, because of my company's negligence? Please advise

Re: Injured back at work
I NEED TO KNOW MORE FACTS BUT I RECOMMEND AN AGREED MEDICAL EXAMINATION (AME) BY A NEUTRAL AME AND IF DEFENSE DOES NOT AGREE TO THAT A QME (QUALIFIED MEDICAL EXAMINER). IF ONE WAS DONE AND THE FINDINGS ARE INCORRECT, YOUR ATTORNEY CAN CROSS-EXAMINE THE DOCTOR AND THAT MAY CHANGE HIS OPINION ABOUT YOUR INJURY.
