Legal Question in Workers Comp in California

I injured my elbow (torn tendon) on the job.... emailed my employer and explained the injury... their answer was "they will get back to me" They never did... I have been to my personal Dr 4 times since and received cortisone shots in the last 1 1/2 years.... This last time my Dr is saying it's not healing and I should see an orthopedic surgeon... All this has been on my own medical plan... Is it to late to file a wc claim to help with the surgery? what about my company never getting back to me... I felt like they just "blew" me off figuring it would go away...
