Legal Question in Workers Comp in California
I injured my lower back on the job December 1996. My employer�s insurance company sent an investigator to my home to get me to sign a waiver in March 1997. I wrote that I withdraw claim for compensation at this time but wish to retain my rights for the future in case the injury returns in the future. The investigator and I signed and dated this paper. Staring around 2005 my injury did return. Damage to the disc resulted in disc denigration over time. I have had to stop pursuing many activities, and work causes sever pain in the damaged disc. I have visited spine specialist and have been advised to undergo disc replacement. My current insurance has been willing to approve the procedure. I now know I will live with this disability the rest of my life. Do I have any recourse against my former employer or its insurance agency.
