Legal Question in Workers Comp in California
I was injured at work, fairly serisouly I nearly chopped of 3 fingers, I have only worked off and on over the past year so my yearly average is much lower than a normal 40 hour week for me but they say thats all I get and there is nothing I can do about it, is that true?

Under the new legislation there is not much you can do because there are really no vocational benefits. However, for an offer of modified work to be considered valid the pay must be 85% of the pre-injury pay and the same hours. Obviously, this offer of modified work is somewhat invalid. Yet, you are working. If there is no modified work available, then your are out of work.
