Legal Question in Workers Comp in California

i got injured on 5/8/2009 and being on workers comp ttd payments until 10/22/2009 since then ive been receiving state disability until 10/7/2010. on 11/3/2010 i had surgery for carpal tunnel on right wrist, and the workers comp insurance began to pay me ttd payments. Would they have to pay me any back pay ttd payments that i never received from them? or what do i need to do? Can your firm help me?

You should contact some applicant's attorneys in the area in which you live. State Disability is only for non-work injuries, and they can impose a lien on any TTD owed for the same time as they paid. I do not understand why there was a break in TTD payments unless a Dr. said you were able to return to work or your condition was permanent and stationary. You need to find out from the claims adjuster why there was such a gap in payment.

Unless your doctor said it was okay for you to go back to work, you should have been receiving your TTD payments. I will be glad to give you a free consultation if you call 1.877.505.INJURY.
