Re: injury again

You should receive the report back within 45 days. The Labor Code has time limits which the doctors MUST adhere to. If not you can request a new exam. I do not know if this was an exam from a Panel Qualified Medical Examiner (PQME) or an Agreed Medical Examiner (AME), or a doctor that the insurance company sent you to. If it is a company doctor you may be able to object to it and get another opinion. There are different scenario's depending on the type of exam this was.

If you have an attorney you should talk to them because "apportionment" between the 2 injuries may be applicacable. Since they are separate body parts, there may not be apportionment.

If you do not have an attorney you should consult one as there are complex issues and the law has changed dramatically since your injry 6 years ago.

If you have any further questions, feel free to contact Law Guru or myself. Thank you for your inquiry and Good Luck!
