Legal Question in Workers Comp in California

Injury on the way to work (both on campus)

I am a student and an employee at a public University. I tripped on an area that has unstable conconrete and now need knee surgery. I am uninsured and want to know if the University could cover the medical costs?

If you fell on your employer's premises while taking a direct route from where you exited your transportation to your job site and you were going there to work, then it is a Workers' Compensation injury and your employer has to pay for your lifetime for

all medical treatment reasonably necessary to cure or relieve from the effects of the injury, although with temporary disability payments to cover partially your wage loss, permanent disability for the reduction in the ability to compete in the entire labor market [normally based upon what physical limitations you have, even though you never planned on having a job involving more than lifting a briefcase], and vocational rehabilitation. You are also entitled to be treated as though you were not gone form the work place so that you earn the same amount of sick leave and vacation as though you had still been working and for any promotion your time off work must be ignored.

The first thing you need to do is to report your work-related accident to your employer. There are many factors which determine whether an injury is work related such as location and time of your accident, why and to what the purpose you were walking at the place of the accident.
