Legal Question in Workers Comp in California

Are insurance adjusters allowed to do their own investigations for work injuries when you're out on leave or do they need to use a real investigator? What if they're going on bad info./assumptions about whether you're supposed to be at work when you haven't even been offered a temp assignment? Short of telling the adjuster's supervisor, is there a way to find out what rules they need to follow? He's even tried changing my medical appts. behind my back to allow me to work on a day that my supervisor said don't come in, which caused me to lose my appt. and forced me to reschedule it. Are they allowed to run all over you like that? I've been begging work to reassign me but they'd rather waste time/money trying to prove I'm doing something wrong when I'm not, nor wouldn't. Is this relatiation if my employer is also seen spying on me WITH the adjustor?

Insurance companies must investigate claims for injuries. They either do that in-house or use an outside investigator. You have provided facts that may give rise to invalid or illegal conduct on the part of the insurance company. I strongly suggest that you consult with a workers' compensation attorney as soon as possible. You can locate attorneys in your area by going to the California Applicants' Attorneys Association website at www.caaa.org. Initial consultations are free of charge. Good luck!
