Legal Question in Workers Comp in California

Insurance stopped paying Temporary disability

I have a lawyer, but I feel neglected as I cannot talk to him, only his aid as he is so busy. April 18 2004 I was struck by backhoe and thrown 5 feet backwards. Occupational DR says I'm ok, my DR says nerve damage but insurance company will not clear procedures to justify his theory. Now i'm on 4th DR with the same results. One year after accident I saw the Insurance company DR and he says I am permanent and stationary and does not rate me for state disability. Insurance company send me a letter on october 7th 2005 stating I will not recieve payments because of what the Insurance company DR stated. I find out old company was faking my check stubs and was not paying taxes or california disability insurance so now I am unable to recieve state disability. Lawyers aid tells my DR to release me on limited duty when he believes I should not work so I can obtain a job as I have no other income. I feel as though i'm being cheated by my lawyer, what should I do?? Could I file a lawsuit against old company for not paying taxes or disability insurance so I can not get state disability?? Lawyers aid says get a job, only job I can get with limitiations is flippin burgers for 6.75/hr, when I was hurt I was making 32/hr, 6.75 won't pay bills..!

confusing

The question is confusing because your doctor should be the occupational doctor. In any event, if you need assistance, you can always speak with the information and assistance office, who will actually review your file.

You might consult a labor attorney regarding the employers' failure to pay state disability premiums.
