Legal Question in Workers Comp in California

Job Harassment

Job harassment while filing workers comp. form. Standing over, yelling, accusations. Do I report incident to workers comp. investigator? EDD office? I've already set appt. to file with Labor board in Nov. 07

If the harassment is a direct result of your industrial injury you should seek representation with a comp attorney who can file a discrimiantion claim along with your application for adjudication of claim. If you succeed in your discrimination suit you will receive a 50% increase in any benefits and may be able to file a civil suit. Additionally, any settlement within the comp arena is tax free However, if the harassemtn is not related to comp, you should not seek redress with a comp claim or attorney.
