Legal Question in Workers Comp in California

new Job?

I hurt myself a year ago, and ive been going to physical therapy. I recently saw a surgeon and he said we should do surgery. The question I have is this. I got offered a new job in a different company. If i left the company I got hurt at, would I still be eligle for the workers comp for my injury?

You will be still eligible for medical treatment and a settlement for your permanent disability. However, if you don't file your worker's cpmpensation lawsuit against your former employer before you started with your new job , your case may get complicated because your former employer will argue that your new job may have contributed to your injury. Taking a new job should not impact your claim for workers' compensation against your former employer. However, your former employer will hire doctors who may claim that your injury was exacerbated by your new employment.

The employer's nsurance company is really skilled at working its files, so you should retain an attorney who is more skilled than those at the insurance company to represent you with your claim.
