Legal Question in Workers Comp in California

job injury discrimination retaliaition

I was hurt at work 3 times over a 4 year period. All have resulted in permanent damage. I got bad knee strains in 1998 and a hernia lifting at work. The hernia was repaired and came back to work after 6 weeks. I re-injured it when my boss had me lifting boxes. After the re-injury my annual raise was denied, job title changed, written up for something small and perceived disabled on paper.I was laid off 2 months later. The unemployment and re-injury claim were denied. My employer replaced me after termination.I have copies of many job ads placed in the paper and online. After 10 months of pain the hernia was repaired. Now I have nerve damage down the left and inner thigh to the knee cap. No payments ever were received. In 4 years I had great reviews and called in sick once. I work full time at another employer but in pain though. What kind of case is this? No litigation yet after 3yrs now.

Re: job injury discrimination retaliaition

You have potential workers compensation and wrongful termination cases -- WHAT IS THE DATE OF THE TERMINATION? You need to get into court on these claims, or you will lose the time to do so -- for a termination of your employment, (depending on the date of termination) you have two years to file a court case. . . the workers compensation claim is likely still open -- you leave out a lot of facts, so its hard to give you concrete answers, but you need to find a lawyer immediately to make sure that you do not lose the time to file suit.
