Legal Question in Workers Comp in California

Am an landscaping employer. Issue 1099M for employees who do the same work when finished for the day with me. Now one is filing for WC. How do I prove that the injuries are from me and not from him doing his own business?

First, the courts are not impressed by 1099s. Instead, they look at several factors to determine employee vs. independent contractor. With regard to proof, that is what litigation is all about.
