Legal Question in Workers Comp in California
Can I leave the state and still get my wc benefits?
My doctor has made me p&s as of 4-26-05. I am awaiting my paperwork for a medical exam and evaluation. I also want to move to the state of washington, in the near future. I want to know if I can move and still recieve all benefits im eligable for with workers comp? Ideally, I want to relocate and then take advantage of vocational rehab and or take a settlement for my case and retrain in my future home. I have had carpel tunnel in both hands and I am not able to return to my current occupation. Also what takes place in a rating exam and evaluation? Thank you.

Re: Can I leave the state and still get my wc benefits?
Yes, you can leave the state and receive WC benefits. However, the out of state doctor must comply with reporting requirements of California Law, which most will not do.
There is no vocational rehabilitation for your injury unless the date of injury is before 1/1/04. If so, then you might be able to get an out VR. However, again, the counselor must meet CA reporting and licensing requirements.
