Legal Question in Workers Comp in California

liability, risk management company

My worker's comp claim is being handled by a risk management co..

I sent them a certified letter demanding all reports and documents they obtain concerning the case. They didn't send me several key docs. and reports which has delayed the claim for over a year...Since they've violated their obligation, can they be sued in civil court for ''professional neglect'' and/or for other reasons?

Re: liability, risk management company

The WCAB has sole jurisdiction over your comp matter. The real question is, why is RMC handling your claim, why not an attorney that will be looking out for your interest?

RMC is not your friend and their job is to look out for their interest only, and not yours.
