Legal Question in Workers Comp in California

How long is an employer obligated to pay the benefit premiums for an employee who is off work due to a W/C injury (State of CA).

ANSWER: 0 weeks!

the premium you paid WAY BACK 6 months or 1 year ago covered the injury to that employee who is off now. If you stopped paying your premiums altogether today, that old loss for that employee is still covered.

CONCERN: IF YOU STOP paying for Workers Comp now and that employee returns you are in violation of the Labor Code. If you have ANY EMPLOYEES you MUST pay for workers comp insurance for future losses.

IF YOU ARE OUT OF BUSINESS and there is no more business and there will be no more employees every in the future, stop paying for workers comp. That loss on that prior employee is already covered.
