One year from the date of injury or last providing of WC benefits, but within 5 years of injury.

One year from the date of injury, or one year from the last date of medical treatment, or one year of learning of an injury if you are claiming a cumulative trauma. LC 5410 does provide a five year statute of limitations. However, if any of the above apply, then you can successfully argue that LC 5410 is irrelevant.
