Legal Question in Workers Comp in California
Loss of quality of life after work injury
After returning to work from a three-month medical leave (through disability)I've had to sacrafice a previous and sizeable monthly clothing allowance. This was orginally under wkmn's comp for a year, after an injury at work, then transfered to disability when requested for a leave. It's all been very complicated and no one gives you a straight answer. I want to know at this point, what I'm entitled to under the wkmn comp law. I've been labled perm-n-stationary when my case was considered ''closed'' right before my leave. My back pain is considered chronic and I have been released w/no restrictions except for a cap on hours. Do I get any kind of restitution for
being forced (because of no real progress of injury over a year)to go on a leave, only to return to a less position with everyday pain?!

Re: Loss of quality of life after work injury
When you are deemed permanent and stationary it is critical to your final award to have your work restrictions opined by a doctor who is applicant oriented, and not one on your employer's insurance company payroll. The worker's compensation system is very adversial. The insuarance companies will get away with anything they can. They will pay you the minimum on your claim unless you obtain representation to protect your interests. The worker's compensation insurance companies have attorneys, why don't you??
