Legal Question in Workers Comp in California
mandatory settllement conf
I am at the last stage of my workmans comp case,I have been on my own,at the mandatory settlement conf. will the defense attorney try to make an offer with myself or does the judge make all the decisions and settlement,my injury was 7/20/2004 I became P/S Dec. 2004 by a QME,I have been rated at 40% P/D by the state. I have been back to work and allowed to work at the same job, I only missed roughly seven weeks of work in 2004 since the injury. This is a spine injury. Also does this fall into new law or is this old law and can I fight for it to be old law.
Thank you
I hope this is enough

Re: mandatory settllement conf
If you were P&S'd in 2004, then the 2004 rules apply to your case. At MSC, either side can make an offer of settlement. Whether it is enough or not for your case, you really need an attorney to take a look at the medical file.
The Judge will oversee the process since you are unrepresented but he/she could have a lot of cases on calendar that day and may not have much time to spend with you. Good luck.
