Legal Question in Workers Comp in California

MD refusing to wait for payment from Workmans Comp, sending acct to collections

Sustained a work related injury in March 2006 resulting in surgery the same month. At the time of injury it was not treated as workmans comp. That ruling was made July 2006. The assisting physician claims that he does NOT accept WC claims,wants the money from us. WC has NOT yet paid the bill, but keeps telling us that this physician has no choice in the matter. Now this doctor is sending US to collections. Is he required to accept payment from WC or can he come after us?

Based upon the facts that you gave in your question, the "ruling" that you referred to is simply a denial. The question should not be whether or not the provider can come after you for the costs of services, but why didn't you hire counsel?

You need to hire an attorney to send you to a doctor that accept denied cases if there is merit to the case. As far as the bill, you need to provide the clinic with the claim no. of the worker's compensation insurance and ask them to file a lien. If you need any assistance, call us at 213.388.7070.
