Legal Question in Workers Comp in California

medical benefits through work

my finance has a workmans comp case for his knee.while he was out he work terminated his medical benefits through them. is that legal? and if they put him back on their plan. does he have to pay his portion back when he goes back to work. who is obligated to pay my health insurance through my work if my finance is on work comp?

Pursuant to Labor Code, Section 4600, the employer is to pay all costs for a work-related injury. However, this depends on whether a case was denied or accepted.

To answer your question, he should not have to pay anything if the case was accepted and the medical insurance company should file a lien in his comp case so to protect your fiancee from any deductibles.
