Legal Question in Workers Comp in California

After going on medical leave from work for 3 weeks, can you start going on Workers Comp case due to stress related work (Anxiety Disorder diagnosed from my Dr due to work stress) related issues? Can you start this process in the middle of a leave? the First three weeks I was paid sick leave, I do not feel that I can go back to work yet sue to this disorder. What can I do? I am to report on Sunday July 3rd.

You can file a WC claim but most employers and carriers almost automatically deny psyche claims. It will take many months before the WCAB would make a decision. You need to contact some WC applicants attorneys to see if they will take your case. But it may also mean that you will never be able to go back to work at that company.
