Legal Question in Workers Comp in California

Medical records release

I have been asked to release my medical records on my w.c. case for work related stress. I was told that if I don't, I might not receive any benefits. I don't feel comfortable doing this. Do I have to release my records to have my case decided?

Re: Medical records release

When you file a stress claim your past history becomes important as to any other facts in your past that could be contributing or causing your emotional condition now is relevant. Thus, your medical records for a physical injury if you have one and your emotional history are discoverable and a release of these records would be necessary and required. Good Luck and hang in there!
