The insurance company has sent me a medical records release that ask for allof my personal medical records for the last ten years. Also requesting a release for any information regarding educational institutions I have attended. they also want a release to investigate all past employers. They have accepted the claim. A release was signed at the treating doctors office giving them access to records regarding the injury.Exactly what are my obligations . How far can they legally go? Any Advice?

Re: Medical Records Release

The insurance company is trying to determine the following:

1. Past injuries that may relate to your present condition. This is so that they can reduce the amount of your claim value by blaming some, of not most of your injury on a past condition.

2. Other ways you may have injured yourself (But they did accept your injury, so this may not be that big of an issue)

3. The nature and extent of your current injury. The want to make it seem like youre not really injured that badly.

The problem is that it is the goal of the insurance companies to not pay, or pay as little as possible on your claim, even at the sacrifice of your rights to benefits. It is probably a really good idea to call my office for a free consultation. Please note that should you choose to retain me or another workers comp attorney, there will be no out of pocket expenses on your part relating to attorneys fees.
