9 to 15% but almost all attorneys charge 15%.
$0.00. The client pays nothing up front. Instead, the attorney could receive 12--15 pct of the clients final recovery. Most attorneys take 15 pct, but given the labor intensive nature of workers comp, it should probably be 20 pct. Disclosure: My firm becomes involved in heavy litigation, as opposed to accepting quick defense lowball offers, (this statement is not intended to generate any promises or guarantees of large settlements). However, there are firms who's more focused on many, and fast settlements. Maybe the courts should scrutinize the fees based upon the attorney.

RETAINER FEE FOR INJURED WORKERS in the Workers Compensation system is illegal. The attorney may not accept money up front from any worker ,,, the attorney may only receive what a WCAB Judge awards. In high-rent areas, judges award 18% (Marina Del Rey comes to mind). Most judges only award 15%. EMPLOYERS who are uninsured are another matter entirely; i typically charge $4000 to start out on an uninsured employer defense.
