Legal Question in Workers Comp in California
I operate a countertop business in CA without worker'comp insurance. Predictably, a worker got injured and now he has hired an attorney who just called me asking for my worker's comp policy info, which I don't have. I guess a claim will be filed and big trouble is coming my way. How can I protect myself?

You have already committed the foul so you will suffer some penalty, the question being how much. You first need to contact an experienced WC attorney and find out, based upon the facts, what exact dangers face you and what you should do. Is the worker really your employee, are the elements of emplyment sufficient You should buy a WC policy now. Find out what the injured worker is suffering from, how serious the injury is, what type of treatment will be necessary, overall likely cost, and when ready make a settlement offer. See if there is some light duty you can give him to reduce the amount of TD, See if you have any other type of insurance coverage that might protect you and consider making a claim. Read the relevant passagers on UI employers in Nolo Press or other WC books written in language you can understand.
