Legal Question in Workers Comp in California

Overpayment of a settlement

I received an overpayment, I called the attorney, and I called the company insurance. I was told by company insurance they could not discuss. I was told by several representatives that the settlment amount was correct and that I had misunderstood. After spending money received paying bills, I get a letter saying I was overpaid, that now I misunderstood attorney, etc. I have now beem told I have to pay 580.00 a month for 12 months, which I cannot afford and they won't negotiate. How can I have them negotiate a lower amount? I cannot survive on this payment schedule.

I agree with Mr. Lupoff. Something seems amiss.

I really do not understand your circumstances based upon the information or lack thereof that you provided in your question. However, the fact that you must pay the amount of $580.00 to someone does not sit right with me. You need to meet with your attorney and review your case with him/her and figure out how you ended up in this mess.

Good luck.
