Legal Question in Workers Comp in California
I'm an owner operator, I was injured while working by a third party, I've been on dissability for 7 months, the dr.s are taking care of my problems, but the company I'm leased to wants me to give them answer as to when I'll be able to work. No dr. has told me I will be permantly dissabled but work is asking me to give an answer as to when I'll be back or they will terminate my contract. Since my truck is too old to be considered for a re-hire I won't be eligible to me re-hired, thus for I will be out of a job. Is this legal?

You may ask about your job restriction from your treating doctor and ask your employer if they can accommodate your restriction. Your employer can't force you back and if they terminate there is a penalty under labor code 132(a). Feel free to call us at 213.388.7070 for a free consultation.
