Legal Question in Workers Comp in California

not getting paid by the workers comp carrier i was a vendor for

I provided certified interpreting services on a workers comp case for the insurance carrier, through their defense attorney. The carrier has not paid me and the atty is not going to help me collect payment. What can I do to collect? These services were NOT on a lien.

If the attorney is not an employee of the carrier, the attorney owes you the money, not the carrier who merely reimburses the attorney for his billings for time and expenses. Tell the attorney to pay up or you will have to file a Bar complaint. If that does not work, sue in Small Claims Court.

If the attorney works for the carrier, ask them why there has been no payment and if they will not pay go to the Department of Industrial Relations with your complaint. Then you might have to sue in SCC.
