Legal Question in Workers Comp in California

Payoff amount

My wc company wants me to take a payoff, I have disk degeneration and have been off work since Nov. They want to give me 21,000 and cut all ties, is this too low an amount or should I get an attorney to seek extra cash and future med needs?

Re: Payoff amount

The decision to take a lump sum settlement and thus effectuate a total closure on your claim is one that should be carefully considered as you may lose other rights that you would be entitled to that can far exceed the amounts offered by the carrier at this point.

Whether the amount you have been offered, however, is fair and reasonable requires a detailed analysis of your claim file including medical determinations made and thus cannot be stated here with any certainty as there are several factors that go into establishing a fair and reasonable lump sum settlement.

Thus before you jump into a lump sum closure agreement with a carrier consider the most important fact that the carrier does not represent your best interests and is not required to protect you or your rights, that's your job.

Sincerely,

Attorney Marsili
