Legal Question in Workers Comp in California
permanent & stationary
I have been P&S'd and have received a copy of the report. It's states my condition, ratings, future med requirements, etc., But my case mgr keeps telling me that she is waiting for a final rating. Isn't the rating on the report stands as is? or is there another ''official'' report that she needs to see? Also, a nurse case mgr wants to meet w/me tomorrow to discuss the meds I'm taking and other issues, I guess. Do I have to comply to this interview even though I've been P&S'd? She is not my regular nurse case mgr. She was assigned to me by my WC insurance company.

This matter is complex and you should not try to do it yourself so you should get an attorney to discuss your options. If you are located in Southern California, you can email me your contact info, so we can discuss your particular situation. There is no charge for consultation.
Re: permanent & stationary
you have the option whether or not you have a case manager on your case. usually they are only assigned to complex cases or cases wherein lots of medication is involved. you can dismiss her if you are unhappy and request another.
while not mandatory, the disability evaulation unit provides a rating of permanent and stationary reports if the parties disagree as to the rating of the report, but not the report itself.
Re: permanent & stationary
The question is, how do you feel about your case manager? Do you believe that she is on your side? If not, request another one.
The insurance companies usually assign case managers to more complex cases and thus, you may have a complex case.
