Legal Question in Workers Comp in California
person filing claim isnt who they say they are they have filed wc law suit I am not carrying wc insurance is terir claim ligitimit
1 Answer from Attorneys
If they are employed by you and suffered an injury in the course and scope of their employment for you, they wold be entitled to WC benefits. If you are uninsured, they can file a civil suit against you and liability is automatically established against you and the only issue is damages. If they are not in the US legally, I am not positive but I think they still would be entitled to benefits. As an employer, you are supposed to check to see they are legally entitled to work. Contact the legal adviser, if they still have one, at the local WCAB to see what their position is. You may need an attorney to at least explain to you what the damage award against you could be.
