Legal Question in Workers Comp in California

If a person has an old workers compensation case that has been settled but the medical is still open; and now the person has medicare and the workers comp. ins. wants to settle on the medical. How would a medicare set asside account work if there was medical treatment needed that was not normally covered by medicare and therefore I believe could not be paid for out of the medicare set asside account. Would this be able to be paid from the medicare set asside account or would the person have to pay for it with their own money.

Either medicare pays for the treatment, or it does not. If treatment relates to the work injury, then it should be paid for from the set aside account. You are making the matter far too complex.
