Legal Question in Workers Comp in California

My primary care physician requested a psychiatric consultation from the insurance company in my Workers Comp case due to my extreme depression since my injuries. It was denied they said due to.. " #1 Although liability has been accepted for (my name) claim of industry injury to the knees (both), the additional body parts of mental/mental have been denied. #2 Psyche consultation not authorized pending report from Pain Mgmt consultant, Dr. (name)."

I want to know what does this mean? Are they saying that they need a full report like the final report from pain mgmt? Or just the report about the actual consult? Are there specific procedures for psychiatric consults by Workers comp? Does this mean they will approve the consult eventually or not? Thankyou.

Insurance company always want to limit their exposure by accepting only the most serious injury and denying the others. You have a right to get psychiatric consultation, insomnia consultation and other type of treatment as long as they are related to your injury. If insurance company doesnot authorize such treatment you are nevertheless entitled to it. That's why you need to retain an attorney who can send you to appropriate doctors that are specialized in their field and are willing to take your case on lien basis.
