Legal Question in Workers Comp in California

I am P&S on a surgically repaired ruptured patellar tendon. The comp carrier is offering a cash settlement to forgoe future medical. I have not had treatment on the knee for 2+ years. What would be considered a fair cash out?

Does the QME or the Treating physician write you will need a knee replacement, additional surgery, pain injections?

Will your personal insurance refuse any knee treatment in the future because you had a work injury on that body part?

Start asking $25,000, and if they only come up with $4000, START GOING TO THE DOCTOR AGAIN so they get medical bills... an adjuster who hasn't had medical bills for 2 years has no reason to come up with much money.

an adjuster who is getting medical bills on the knee every 2 months has a reason to come up with $20,000 to get rid of this nuisance.
