Legal Question in Workers Comp in California

QME Referral

JT2 and I requested a physc referral for my stress claim from my QME and it has been over two months since the request and have not heard back regarding this. I have called JT2 and they are ''looking'' into this. How long do I have to wait before JT2 is considered negligent in my request? Now how do I proceed?

Re: QME Referral

It is already too late. File a penalty petition related to unreasonable delay in medical treatment along with a DOR. If an appointment has not be scheduled by the time the hearing is set, you have a good chance of obtaining a 25% penalty.
