Legal Question in Workers Comp in California

Received a notice of hearing - lien conference after my wc case settled in May 22, 2012. under special comments/instructions, it states "applicant need not appear; all lien claims of record still in dispute shall appear". what does this means?

Did you represent yourself in the workers compensation matter? The lien claimants are the medical providers typically who have not yet been paid in full and who therefore put a lien on any settlement that you received. Typically the settlement agreement would have stated that the lien claimants needed to be paid by the workers compensation carrier separate and apart from your settlement that you received. Thus typically the payment of the lien claimants would be a matter between that lien claimant and your workers compensation carrier and that is why the notice of hearing stated that you need not appear. I recommend that you review your settlement agreement to make sure that it states that the lien claimants would be paid separate by the workers compensation carrier and I would also recommend that you consult your attorney if any. It means that you need not appear. This is a hearing for your medical providers who have outstanding bills/liens which have not been resolved. The Workers' Comp Appeals Board still has jurisdiction over the remaining liens.
